1. Who we are
This website, accidentvehicleclaims.com, is operated by Accident Vehicle Claims ("we", "us").
We are not a law firm. We are not a lawyer referral service. We do not provide legal advice, legal opinions or legal representation, and no attorney client relationship is created by using this website or submitting the form. We operate a marketing website that collects accident details and passes them to participating attorneys and marketing partners.
2. Information we collect
Information you give us
Through the case review form we collect:
- Identifiers: first name, last name, phone number, email address and ZIP code.
- Accident details: date of the accident, state where it occurred, type of accident, your role at the time, who you believe was at fault, whether a police report was filed, whether the other driver was insured, and whether there were witnesses, photographs or dashcam footage.
- Health related details: whether you were injured, which parts of the body were affected, whether you have received medical treatment, and how much work you have missed. This is sensitive information and is described further in section 9.
- Vehicle details: year, make, model, licence plate if you provide it, severity of damage, and what assistance you still need.
- Claim status: whether you hold auto insurance, whether you are already represented by an attorney, whether an attorney has previously declined or dropped the matter, and whether an insurer has made you a settlement offer.
- Anything else you choose to type into the free text notes field. Please do not enter payment card numbers, Social Security numbers or government ID numbers. We do not ask for them and we do not want them.
Information collected automatically
- IP address, browser type and version, device type, operating system, and approximate location derived from IP address.
- The page you arrived from, the pages you viewed, and the date and time of your visit.
- Campaign parameters attached to the link you clicked, such as UTM tags or a click identifier.
- A consent certificate. We use a third party consent verification service to record the exact page, form and disclosure text you saw at the moment you submitted, together with a timestamp. This is retained as evidence of the consent you gave.
3. How we use it
- To review the accident details you submitted and assess which participating attorney is appropriate for your state and case type.
- To transmit your submission to that attorney or law firm, and to marketing partners, so they can contact you.
- To contact you ourselves by phone, text or email about the submission you made.
- To detect and prevent fraudulent, automated or duplicate submissions.
- To measure how our advertising performs and to improve the website.
- To comply with law and to establish or defend legal claims, including demonstrating the consent you provided.
4. Who we share it with
We share the information described in section 2 with:
- Participating attorneys and law firms licensed in the state where your accident occurred.
- Marketing partners and lead buyers. The current list is published and kept up to date at accidentvehicleclaims.com/partners.html. This list may change, so check it before you submit.
- Service providers who operate the website, hosting, form delivery, call handling, email and consent verification on our behalf.
- Legal and regulatory recipients where we are required to disclose by law, subpoena or court order, or to protect our rights.
- A buyer or successor if our business or its assets are sold or reorganised.
5. Calls, texts and your consent
By ticking the consent box and submitting the form, you give prior express written consent for us, the participating attorney or law firm we refer you to, the marketing partners listed on our Partners page, and their respective agents, to contact you at the phone number and email address you provided. That contact may be by live call, prerecorded or artificial voice, text message and automated telephone dialling system, including where the number you supplied appears on a federal or state do not call registry.
- Consent is not a condition of obtaining any goods or services. You can instead call us directly on (800) 555-0199.
- Message and data rates may apply. Message frequency varies.
- To stop text messages, reply STOP to any message. Reply HELP for help.
- To stop marketing emails, use the unsubscribe link in any email, or write to us at the address in section 12.
- Withdrawing consent from us does not automatically withdraw it from an attorney or partner who has already received your details. You will need to tell them directly.
6. Cookies and tracking
We use cookies and similar technologies that are strictly necessary to make the site work, plus analytics and advertising technologies that help us understand where our visitors come from and how our campaigns perform. Some of these are operated by third parties who may set their own identifiers.
You can block or delete cookies through your browser settings. Blocking strictly necessary cookies may stop the form from working. We currently do not respond to browser Do Not Track signals, but we do honour the Global Privacy Control signal where we are required to.
7. How long we keep it
We keep form submissions and the associated consent certificate for as long as needed for the purposes described above and to defend against claims, which in practice means at least the length of the applicable statute of limitations for telephone consumer protection claims. Automatically collected technical data is generally retained for a shorter period. When a retention period ends we delete or de-identify the data.
8. Your privacy rights
Depending on where you live, you may have the right to:
- Know what personal information we have collected, used and disclosed about you.
- Receive a copy of that information in a portable format.
- Correct inaccurate information.
- Delete your information, subject to exceptions such as our need to keep consent records.
- Opt out of the sale or sharing of your information and of targeted advertising.
- Limit the use of sensitive personal information.
- Not be discriminated against for exercising any of these rights.
To exercise a right, email privacy@accidentvehicleclaims.com or call (800) 555-0199. We will verify your identity before acting, usually by matching details against the submission you made. You may use an authorised agent. We respond within the timeframe set by the applicable law, generally 45 days, and will tell you if we need an extension.
9. State specific disclosures
California, Colorado, Connecticut, Virginia, Texas and other states with comprehensive privacy laws
In the twelve months preceding the date of this policy we have collected the categories of personal information listed in section 2 and disclosed them for the business purposes and to the categories of recipients listed in section 4. We sell or share identifiers, internet activity information and inferences for cross context behavioural advertising and lead generation purposes.
Details about your injuries and medical treatment are treated as sensitive personal information. We collect and disclose them only to assess and route your case review request, and you may ask us to limit their use as described in section 8.
We do not knowingly sell or share the personal information of consumers under 16 years of age.
California attorney advertising notice
This website is an advertisement paid for by participating attorneys. It is not a solicitation for legal services relating to an incident that occurred in California or over which a California court would have jurisdiction. Hiring a lawyer is an important decision that should not be based solely on advertising.
Nevada
Nevada residents may direct us not to sell certain covered information by emailing privacy@accidentvehicleclaims.com with the subject line "Nevada opt out".
10. Security
We use administrative, technical and physical safeguards appropriate to the sensitivity of the information, including encryption of data in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Once your details are passed to an attorney or partner, their own privacy practices apply to their copy of the data.
11. Children
This website is intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has submitted information to us, contact privacy@accidentvehicleclaims.com and we will delete it.
12. Changes and how to contact us
We may update this policy. When we do, we will change the "Last updated" date at the top and, where the change is material, give more prominent notice. Your continued use of the site after an update means you accept the revised policy.
